This Privacy Policy explains how Bayou Commerce LLC ("Bayou," "we," "us," or "our") collects, uses, and shares information about you when you visit our website at bayoucommerce.com (the "Site"), join our launch waitlist, or use the Bayou Commerce application for Shopify (the "App"). By using the Site or the App, you agree to the practices described here.
Bayou Commerce App for Shopify
Bayou Commerce is a wholesale ordering application that merchants install on their Shopify store to sell to their approved wholesale dealers. This section describes how the App handles data. In this context, the merchant who installs the App is our customer (the "Merchant"), and the Merchant is the controller of the store and customer data processed through the App; Bayou acts as a service provider (processor) to the Merchant.
Information the App accesses. When a Merchant installs the App, and as dealers use it, the App may access and store:
- Merchant account data — the store's domain, contact email, and account owner name, used to provision the Merchant's account and send transactional emails (for example, a set-password email).
- Store catalog and pricing data — products, variants, prices, price rules, and inventory levels, used to present wholesale catalogs and calculate dealer pricing.
- Dealer account data — the names, business names, and email addresses of the wholesale dealers a Merchant approves, along with each dealer's assigned pricing group. Dealers create a password to log in to the Merchant's wholesale portal.
- Order data — draft orders and orders placed through the wholesale portal, including line items, quantities, totals, and the associated dealer and shipping details, used to create and track wholesale orders in the Merchant's Shopify store.
How the App uses this information. Solely to provide the wholesale ordering service to the Merchant: authenticating Merchants and dealers, displaying dealer-specific catalogs and pricing, creating and processing orders in the Merchant's Shopify store, sending transactional emails related to the service, and maintaining the security and integrity of the App. We do not use App data for advertising, and we do not sell it.
Service providers used by the App. The App relies on Shopify Inc. (the platform the App runs on and the source of store, product, and order data), our application hosting and database provider, and Resend (an email delivery service used to send transactional App emails). Each processes data only as needed to provide the App.
GDPR and data-subject requests. In accordance with Shopify's requirements, the App responds to Shopify's mandatory privacy webhooks. When a store customer requests their data or requests deletion, or when a Merchant uninstalls and requests store data deletion, Shopify notifies the App and we handle the request accordingly. Data-subject requests from a Merchant's dealers or customers should be directed to the Merchant as the controller; we assist Merchants in fulfilling them.
App data retention. We retain Merchant and dealer data for as long as the Merchant has the App installed. When a Merchant uninstalls the App, we delete or de-identify the associated store, dealer, and order data within the timeframe required by Shopify, except where we are required to retain it by law.
Information we collect
We collect information in the following ways:
- Information you give us. When you join our waitlist, we collect your email address and, if you choose to provide it, your first name. This is the only personal information we ask you for on the Site today.
- Information collected automatically. When you visit the Site, our hosting provider and any analytics we use may automatically record standard technical information such as your IP address, browser type, device type, the pages you view, and the date and time of your visit. This information helps us understand how the Site is used and keep it secure.
- Cookies and similar technologies. The Site may use cookies or similar technologies to remember your preferences and measure traffic. You can control cookies through your browser settings. See the "Cookies" section below.
How we use your information
We use the information we collect to:
- Add you to the Bayou launch waitlist and notify you when Bayou becomes available;
- Send you occasional updates about Bayou's progress and early-access opportunities, if you have signed up to receive them;
- Operate, maintain, secure, and improve the Site;
- Respond to your questions and requests; and
- Comply with applicable laws and protect our legal rights.
We do not sell your personal information.
How we share your information
We share your information only with service providers that help us operate the Site and our waitlist, and only as needed for them to perform their services for us. These include:
- Mailchimp (Intuit Inc.), which stores our waitlist and sends our email communications;
- Our website hosting provider, which serves the Site and processes form submissions.
We may also disclose information if required to do so by law, or if we believe disclosure is reasonably necessary to comply with a legal process, enforce our terms, or protect the rights, property, or safety of Bayou, our users, or others. If Bayou is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.
Data retention
We keep your waitlist information for as long as you remain on the waitlist or subscribed to our updates, and for a reasonable period afterward to maintain our records. You can ask us to remove your information at any time, and you can unsubscribe from our emails using the link in any message we send.
Your rights and choices
Depending on where you live, you may have the right to request access to, correction of, or deletion of the personal information we hold about you, and to opt out of marketing communications. You can:
- Unsubscribe from our emails at any time using the unsubscribe link in any email;
- Contact us using the details below to request access to or deletion of your information.
We will respond to verified requests as required by applicable law.
Cookies
Cookies are small text files placed on your device. We use them, and similar technologies, to keep the Site working properly and to understand how it is used. Most browsers let you refuse or delete cookies through their settings. If you disable cookies, some parts of the Site may not function as intended.
Children's privacy
The Site is intended for business owners and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it.
Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. We encourage you to review this page periodically.
